How we collect your personal information

We may as a result of your interaction with our website and when you apply for a loan store and process your information on our systems and computers. We will also collect and store personal and financial information about you when you provide us with information over the telephone, when you send us documents and when we access information held by credit reference agencies about you. We also collect personal information when we communicate with you during our servicing of your loan agreement with us.

The types of personal information we collect from you and the legal basis for its collection

The UK’s data protection law allows us to process your personal data where we have a proper reason for doing so. Such reasons include to fulfil a contract we have with you, where it is in our legitimate interest, where we have a legal duty and when you consent to it. A legitimate interest is when we have a business or commercial reason to use your information and this is not unfairly against your interests. The legitimate interests we are pursuing comprise the following:

Promoting responsible lending decisions: We collect personal and financial information from you and from credit reference agencies (CRAs) to help us to assess your ability to repay your loan with us.

Such information includes your current and recent addresses, personal data about bank accounts, credit cards, mortgages and other agreements that involve a credit arrangement like utilities and communications contracts (including mobile and internet) and how you are meeting your payments obligations to these organisations and whether you have any court judgments.

We also collect personal information about your age, about your employment and income, your e-mail address and mobile phone number, whether you are on the electoral role and whether you are a homeowner or a tenant. We may also collect information about a business you are involved with where you are self-employed including requesting financial records, such as accounts and information held by public bodies such as Companies House.

Prevent and detect crime: We collect personal and financial information from you and from credit reference agencies and public or government bodies to help us to detect and prevent crime and fraud and to verify your identity under our anti-money laundering obligations.

Servicing of your loan: The personal information we collect about you will enable us to communicate with you about your loan and to service your account, for example to provide regulatory notices and statements, to process your payments onto our systems and to contact you about any missing payments. We will make a record of our communications with you and your account activity (including recording telephone calls) to help us to monitor and manage your account, check that we are providing an adequate service and to help us to deal with any complaints. We will collect information about your bank account and debit card details to enable us to collect your loan repayments.

Improve our services and products: We will use your information, for research, assessment and analysis (including credit and/or behaviour scoring, market and product analysis) and to develop and improve our services to you and other customers.

Marketing

We may use your information to inform you by post, telephone or other electronic means (such as e-mail or SMS text), about other short term unsecured loan products from us which we believe may be of interest to you. We will only do this if we consider that this type of processing is for a legitimate business interest of ours or is with your consent.

Disclosure of your personal information

We may give information about you and how you manage your account to the following and on the understanding that they will keep the information confidential:

a) People who provide a service to us or are acting as our agents. This includes any organisation where we have decided to outsource all or part of the administration or servicing of your loan;

b) Our insurers, auditors and accountants, solicitors, consultants and other professional advisers;

c) Anyone to whom we transfer or may transfer our rights and duties under your loan agreement (for example if we were to sell your agreement to another loan company);

d) Any funders or investors (or prospective funders or investors) of our business;

e) To credit reference agencies and fraud prevention agencies (see below);

f) We may also give out personal information about you if we have a duty to do so in order to comply with any legal obligation (including with any Government agencies or regulators).

Otherwise, we will keep information about you confidential.

We from time to time send your personal information for some of the above reasons outside of the UK, for example to some of our investors and funders in the U.S.A. Where the person or organisation we send your personal information to is located outside of the European Economic Area we will make sure that they agree to apply the same levels of protection as we are required to apply to information held in the UK and to use your information only for the purpose of providing the service to us.

Credit Reference Agencies: When you apply for a loan you confirm that all the information you have given is true and complete. We will validate this information in a number of ways:

a) From our own records (for example in respect of a previous loan you have taken out);

b) From information held at credit reference agencies (CRAs). When CRAs receive a search from us they will place a search footprint on your credit file that may be seen by other lenders. They supply to us both public (including the electoral register) and shared credit and fraud prevention information.

We will make checks such as; assessing the application for credit and we may also make periodic searches at CRAs to manage your account with us.

If you tell us that you have a spouse or financial associate, we will link your records together so you must be sure that you have their agreement to disclose information about them. CRAs also link your records together and these links will remain on your and their files until such time as you or your partner successfully files for a disassociation with the CRAs to break that link.

Information on applications will be sent to CRAs and will be recorded by them. Where you borrow from us, we will give details of your accounts and how you manage it/them to CRAs. We will continue to exchange information about you with CRAs while you have a relationship with us. If you borrow and do not repay in full and on time, CRAs will record the outstanding debt and that you have defaulted. This information may be supplied to other organisations by CRAs to perform similar checks and to trace your whereabouts and recover debts that you owe. Records remain on file for six years after they are closed, whether settled by you or defaulted.

Law enforcement agencies may access and use this information.

We and other organisations may also access and use this information held by CRAs to prevent fraud and money laundering, for example, when:

a) Checking details on applications for credit and credit related or other facilities

b) Managing credit and credit related accounts or facilities

c) Recovering debt

d) Checking details on proposals and claims for all types of insurance

e) Checking details of job applicants and employees

How to find out more about credit reference agencies: You can contact the CRAs currently operating in the UK; the information they hold may not be the same so you may wish to contact each of them. They will charge you a small statutory fee (note that the information will be given for free if requested after 25 May 2018).

Retention of your personal information

The length of time we retain your information will depend on the purpose for which the information was provided. In general, however:

a) We will keep the information that is necessary to enable us to manage your account and provide you with a service that you have requested for as long as it takes us to provide that service.

b) We will keep your contact details for as long as we have your consent to send you marketing information.

c) We will keep records of your account history for a period that will not usually exceed six years after your loan has been repaid. This is to allow us to respond to any complaints or disputes that may arise during that period.

d) We will keep other information about you if it is necessary for us to do so to comply with the law or regulatory requirements.

Please be aware that credit reference agencies and fraud prevention agencies who we have transferred your data to in accordance with this notice, may also retain your information for a period of six years.

Data security

At Stagemount Limited we make your safety and security a top priority and are committed to protecting your personal and financial information. Where we collect personal information from you, we will protect that information with controls based upon recognized security standards, regulations, and industry-based best practices. Your personal information is stored in secured servers.

Telephone calls

When you telephone us we may record and retain your call for training and monitoring purposes.

Access to your information

You have the right to request a copy of the information that we hold about you (sometimes called a “subject access request”). If you would like a copy of some or all of your personal information, please email or write to us at our above address. There is £10 charge for this service. After 25 May 2018 there will be no charge although we can charge a reasonable fee if your request is excessive or repetitive. We want to make sure that your personal information is accurate and up to date. You may ask us to correct or remove information you think is inaccurate. You are entitled to request that the personal data we hold about you be erased but only if you can show that the personal data is no longer necessary in relation to the purpose for which it was originally collected or processed by us. This is because it has been obtained in order to provide a loan to you and to service and maintain your loan account as described above and is therefore required for our legitimate interests.
